    Fed appeals court panel says most Obamacare subsidies illegal

    In a potentially crippling blow to Obamacare, a federal appeals court panel declared Tuesday that government subsidies worth billions of dollars that helped 4.7 million people buy insurance on HealthCare.gov are illegal.
    The 2-1 ruling said such subsidies can be granted only to people who bought insurance in an Obamacare exchange run by an individual state or the District of Columbia—not on the federally run exchange HealthCare.gov. The ruling relied on a close reading of the Affordable Care Act.

    "Section 36B plainly makes subsidies available in the Exchanges established by states," wrote Senior Circuit Judge Raymond Randolph in his majority opinion in the case known as Halbig v. Burwell, where he was joined by Judge Thomas Griffith.



    Obama may ask for an en banc ruling, whether he gets it or not is up in the air.​

In Tennessee, those that have Bluecross under Obamacare are facing 19% increase, Humana 14.4% increases.

Bluecross Blueshield is losing money due to Obamacare.....

BlueCross has the majority of Marketplace members in Tennessee by far -- 88 percent. "We're in a very competitive business, so we don't want to charge any more than is absolutely necessary," said BCBST spokesman Roy Vaughn. The requested rate increases, he said, will allow the company to "break even" for its plans on the federal exchange.

"Based on our claims experience through the first half of this year, we're paying out more than we expected," he said. "In fact, we're in a loss position that will be in the tens of millions of dollars."

That loss is due, in part, to the fact that more patients who signed up for health care on the exchange were sicker than insurance companies had expected. They tended to use more health services than the company predicted they would, too. According to the Chattanooga-based BlueCross, the relative poor health of patients accounts for about half of the proposed rate increase -- increases in the cost of medical care account for much of the remaining increase.

As a result, BlueCross said, the consumer will experience a rate increase between 6.1 percent and 21.7 percent, depending on the product he or she has bought. It's difficult to nail down the exact change in product price because Marketplace plans include health care options of various levels, which are priced differently based on the customer's age. In addition, the requested premium increases for all insurance companies would affect the price of the products before any federal subsidy.

News Flash. Obama Administration said that they will continue the subsidies because it was the "Right thing to do." Apparently court decisions don't mean anything to them.

But about two hours later, a Fourth U.S. Circuit Court of Appeals panel ruled 3-0 in another case that the subsidies are legal for people who buy plans on HealthCare.gov, which the federal government operates in 36 states.

While I understand Bluecross and Blueshields concern about the amount they are having to pay out being greater than expected, this would never have been an issue if healthcare had been affordable for everyone before obamacare happened. The fact is the former high rates of healthcare while it was still privatized forced many to just go without, and now that they have access the former companies are learning there is a price to pay for their former rates.

I want you to remember you said this Nautilus about the time you're 41-45 years of age and see the sprawling welfare state that you voted for begin to crumble under a debt so enormous that it's unsustainable.

That's when you'll learn that there is a price to pay for running the national debt up to tens of trillions of dollars for massive welfare handouts which you voted for including Obamacare which is an escalating major expense fueling the deficit between now and then.

In the meanwhile, those working in the private sector are getting slaughtered with obscene rate hikes far higher than they experienced before Obamacare. The result is that employers are:

1. Dropping employer healthcare coverage for spouses, offering only high deductible plans, and minimizing benefits.

Our high debt has already drawn money out of private-sector investment, lowered the growth of GDP and personal incomes, raised taxes, etc... In the future, it's going to push up interest rates, reduce global confidence in the dollar, and give policymakers less room to maneuver when the next serious financial crisis occurs.

The liberal's response? Drive the deficit and national debt up faster and higher by giving as much money away in welfare as humanely possible (even to the citizens of other countries).



Weeeeee! Just remember Nautilus when you're checking those boxes in the voting booth to expand government spending that what goes up must come down.

Now what do you think is going to happen when it must come down?

Do you realize how much money we blow on defense funding that could be put towards our deficit? We spend more on defense then the next 25 countries combined. Maybe thats a serious problem that should be looked at. And we can start reducing it by staying out of the middle east and just letting them bomb each other into oblivion since they all seem so eager to do so anyways.

Although I agree that we need to quit sticking our nose into some of these conflicts, defense spending is a drop in the bucket next to entitlements which make up more than half the annual budget and is projected to engulf a considerably greater percentage in the next decade.
