I need help with legal assistance regarding a family member's court hearing

There is a hearing next week for a family member who needs a new guardian. I need help, as well as prayers regarding things such as courtroom procedures if an attorney can not be found. I've been reassured by the Lord that we will win the case, as long as I show mercy and not seek revenge or to judge someone who may be mentally incompetent. The issues are severe to the point where they could act in desperation when they are replaced, which is sure to happen due to long standing abuses and neglect. Such as, in a probate case such as this, what needs to be done after I have subpoenaed witnesses, some are care providers. Does anything else have to be done before I can question the witnesses in court? Do I have to notify the opposing party as to which witnesses have been summoned? It is a guardianship review hearing in the state of Alaska, and I have not been able to secure an attorney. Does a subpoena of a witness bypass the legal release of information so that they can discuss the case in court? How would I get a release of information from a hostile guardian? Ask the court? the guardian's attorney? What are some guidelines for questioning witnesses?

Prayers would be vital also since the parties, pretty much all of them, are overcome by spiritual bondage, oppression, and typical strongholds, and the strange spirit of confusion that surrounds bizarre cases like this when malicious spirits use their usual weapons, which don't need to be mentioned, since only seasoned spiritual warriors can recognize them or understand the dynamics of invisible fortresses and how they assimilate people who oppose God's power. It could prove to be a dramatic showdown, where I will need faith in God's power, and let the power of Christ and the Angels win the battle. I'm not used to invisible warfare yet, and how to let go and turn it over to the Lord.

The good news is judges are on the side of what is best for the person more because they care than it's their job.

So, if you have legal questions but can't get a lawyer, call the judge to learn what you need to know. For cases such as these, they really do seem to have God's large quantities of Solomon-like wisdom. And they really do want to help.

Lord, work this out for your glory and for the good of all those involved. Amen.

You might start by being a little less ambiguous regarding the specific nature of the legal hearing and what your role in the matter is.

But nobody but a licensed attorney can provide you with legal advice

Findlaw.com might be one place to start but ambiguity will often result in little or no response. Then again there is JustAnswers.com which has professional attorneys which you can ask legal questions. But if not mistaken I believe they do ask a very small fee for each question.

Of course you can always try Google and find local attorneys in your area which might give you a free consultation visit to go over your situation. Anyway good luck.

Thank-you, this was very helpful. I am a younger brother of a family member who is being exploited by an older brother. Psych. experts have said that conditions are clearly present for hidden abuse to be occurring. Having been familiar with the dynamics here for decades, I have do doubt that it could and is likely occurring.

I am the petitioner in the case for a Guardianship review. My concern is procedures for introducing physical evidence and/or witness testimony in a probate case where info is protected by releases of info...

And sorry i don't have any legal advice....hope u can find a good representative tho as acting own your own i know would fluster me.

Surrogate court, guardianship, and the legal standard of what is in the best interest of a pertinent party is best left for a professional legal counselor. Perhaps there is a law school near you that can provide an apprentice attorney who works on a "pro bono" basis while he/she is in internship. Judges do not appreciate people petitioning a court without all pertinent documentation as it leads to delays and extensions in the hearing process. A legal pro would cut through much of the ;legal verbiage and use all the advisable short cuts that might help you more.
