Last Friday was a no go since the judge called me more then an hour after she should've so my ex-employer wasn't available.
I have all necessary papers but, I am nervous and not looking forward to this call tomorrow.
The lady who will be on the phone from my job has been very rude and she lied to unemployment more then once (i have proof of that).
But.. I also didn't follow thru completely w/ what I should've done but, I didn't know either. When I was injured, I had called and let this personnel lady plus my manager know what had happened to me and that i wouldn't be in for awhile. I had told them since I was on Medicaid that I couldn't get an appointment til April 17 to see an orthopedic bc of Medicaid. Both the personnel lady and my manager both told me that the leave of absence papers were to be in by March 15 and no later. I couldn't deliver bc I couldn't get my orthopedic to fill out the papers before he saw me. He refused.
What I didn't do that I should've done (I didn't realize this at the time -- dummy me) --- I should've sent in the papers from the hospital stating what my injury was and stating that I wouldn't be allowed to return to work w/o the approval of an orthopedic (I wasn't aware that I had to do that, so I didn't). I just kept calling once a week to let them know what was going on. Inwardly, I figured I didn't have to call too often because at the time, nothing new was going on. From Feb 28-April, there was nothing new. I was in agony and couldn't walk. I didn't feel the need to keep calling work because I was going to tell them the same thing and they were going to tell me the same thing. I had informed them of that within a week (yes again dummy me, not right away --- i was in agony bc of the injury and wasn't thinking straight).
But, my biggest issue is the personnel lady deliberately lying to unemployment 2 different times stating that I quit on my own terms when I have the paper from Sedgwick stating that they terminated me. And that is all bc I couldn't get my LOA papers in on time.
Anyways, sorry for this long drawn out thing. I'm just very nervous about this 3-way phone hearing tomorrow. I have never had to deal w/ it before and am nervous. I'm nervous about the personnel lady bc she is very conniving, rude, lies and is trying to pull one over on me and on unemployment.
Yes, I don't have all the evidence I should but, I have some. I truthfully don't expect to win this case and get any money but... I have to try and can't give up.
