If you want to hear the Democrats howl, just imagine if it was brought up that Ginsberg needs to be replaced because she is no longer able to do her duties as a Supreme Court Justice.

The important thing is that for the foreseeable future it stacks up to 5 conservatives, 3 liberals, soon to be 6-3 if Ginsburg doesn't return . . . which is very probably at her age. It can take months, if not more than a year to heal her injuries.

I don't see how her health will allow her to continue. IMO, Justices (Federal anyhoo) who reach a certain age should be required to have a Psychological and Medical Evaluation to determine if they are fit to serve on the Bench. Appointed for life was intended to keep Politics out of our Court System..........yeah,,,,,,,,,,,,that was a HUGE failure, right?

My biggest concern about an elderly justice is dementia-related decisions. In the case of mental disease the decision is more likely based on feelings than upon any factual Constitutional mandate.

I don't think they are appointed for life, but may as well be. As long as they can perform their duties as a Supreme Court Justice they can stay. But the Democrats will carry her up on a stretcher and point her in the right direction so that she can give some sort of a head nod to indicate a yea or nay vote, as interpreted by them of course.

Have you ever been to an old folks home. Ginsburg already looks like a woman stationed near a potted plant near the entrance of the doors. And we allow our laws to be influenced by such. What fools we are.

I think it is as long as they can do their duties. Which usually translates into life, but that was before the country was so divided. Now they are going to hang on till the flesh rots from their bones.

Someone can question her ability to serve, but who would do it? If a Republican suggests it, it'll be on the news 24X7 how we are trying to overthrow the court. And a democrat won't do it - they need the vote for their cause. And they know the seat will go to a conservative.

I expect it to be very similar to 'weekend at Bernie's' -- she'll be propped by pulleys until she starts to stink too much.

U.S. Supreme Court Justice Ruth Bader Ginsburg has had a re-occurrence of malignant melanoma, she has told her law clerks. Ginsburg was treated in 1999 for colon cancer and had surgery in 2009 for pancreatic cancer.
She has told key Democratic members of the Senate about her medical condition, including ranking Democratic member of the Judiciary Committee Dianne Feinstein. This explains in part the "take no prisoners" attitude of the Democrats during the Kavanaugh nomination, carefully orchestrating weak 37 year old allegations against Kavanaugh by Women he barely remembers knowing in High School and College.

According to Federalist paper number 78, the Judicial branch of government is intended to be the weakest branch of government. This is because it was meant that the judiciaries strictly upheld the purposes of the Constitution; therefore, individual ideologies did not come into effect. Federalists 78 intended that the Judicial branch of government be independent of the other two branches.

One of the unexpected things that the founding fathers did not foresee was the greatly lengthened lifespan (comparatively speaking) of modern America. At the time of the writing of the Constitution reaching the age of the mid sixties was extremely rare and as a result diseases that come with greater age such as dementia or Alzheimer's was unheard of.

There are a lot of things that exist today they could have never imagined or foreseen.........which is why it is amazing that they published a Document that still stands!

They were smart enough to make provision for amendments to the Constitution but likewise smart enough to make it very difficult to amend. Only 17 amendments have been made (excluding the first 10 since they were added immediately) in over 200 years. One of those amendments (the 27th) took over 200 years to be ratified.

I would go as far as to say they were "inspired." But, I'm sure there are a plethora of folks who would shoot me down on that one. All I know for sure is that their combined effort has stood the test of time.
