CONSTRUCTIVE FRAUD flagbar.gif

"Constructive fraud: A contract or act, which, not originating in evil design and contrivance to perpetuate a positive fraud or injury upon other persons, yet, by its necessary tendency to deceive or mislead them, or to violate a public or private confidence, or to impair or injure public interest, is deemed equally reprehensible with positive fraud, and therefore is prohibited by law, ... 545 People Responsible for America's Woes
by Charley Reese flagbar (1) - Copy.gif

Have you ever wondered why, if both the Democrats and the Republicans are against deficits, we have deficits? Have you ever wondered why, if all the politicians are against inflation and high taxes, we have inflation and high taxes?

You and I don't propose a federal budget. The president does. You and I don't have the Constitutional authority to vote on appropriations. The House of Representatives does. You and I don't write the tax code. Congress does. You and I don't set fiscal policy. Congress does. You and I don't control monetary policy. The Federal Reserve Bank does.

One hundred senators, 435 congressmen, one president and nine Supreme Court justices - 545 human beings out of the 300 million - are directly, legally, morally and individually responsible for the domestic problems that plague this country.

I excluded the members of the Federal Reserve Board because that problem was created by the Congress. In 1913, Congress delegated its Constitutional duty to provide a sound currency to a federally chartered but private central bank.

I excluded all the special interests and lobbyists for a sound reason They have no legal authority. They have no ability to coerce a senator, a congressman or a president to do one cotton- picking thing. I don't care if they offer a politician $1 million dollars in cash. The politician has the power to accept or reject it.

No matter what the lobbyist promises, it is the legislator's responsibility to determine how he votes.

A CONFIDENCE CONSPIRACY

Those 545 human beings spend much of their energy convincing you that what they did is not their fault. They cooperate in this common con regardless of party.

What separates a politician from a normal human being is an excessive amount of gall. No normal human being would have the gall of a SPEAKER, who stood up and criticized G.W. Bush ALONE for creating deficits.

The president can only propose a budget. He cannot force the Congress to accept it. The Constitution, which is the supreme law of the land, gives sole responsibility to the House of Representatives for originating and approving appropriations and taxes.

Who is the speaker of the House? She is the leader of the majority party. She and fellow Democrats, not the president, can approve any budget they want. If the president vetoes it, they can pass it over his veto.

REPLACE THE SCOUNDRELS

It seems inconceivable to me that a nation of 300 million cannot replace 545 people who stand convicted -- by present facts - of incompetence and irresponsibility. (And all should be convicted of dereliction of duty as defined by their oath of office, and in some cases outright treason.)

I can't think of a single domestic problem, from an unfair tax code to defense overruns, that is not traceable directly to those 545 people

When you fully grasp the plain truth that 545 people exercise power of the federal government, then it must follow that what exists is what they want to exist.

If the tax code is unfair, it's because they want it unfair. If the budget is in the red, it's because they want it in the red. If the Marines are in IRAQ, it's because they want them in IRAQ.

There are no insoluble government problems. Do not let these 545 people shift the blame to bureaucrats, whom they hire and whose jobs they can abolish; to lobbyists, whose gifts and advice they can reject; to regulators, to whom they give the power to regulate and from whom they can take this power.

Above all, do not let them con you into the belief that there exist disembodied mystical forces like "the economy," "inflation" or "politics" that prevent them from doing what they take an oath to do.

Those 545 people, and they alone, are responsible. They, and they alone, have the power. They, and they alone, should be held accountable by the people who are their bosses - provided the voters have the gumption to manage their own employees. We should vote all of them out of office and clean up their mess. The election is not that far away!

TRUAX v. CORRIGAN 257 U.S. 312 (1921) -- NO MAN IS ABOVE THE LAW

The real strengths of these Amendments and Act would be threefold:

1. It would enforce the Constitutionality of Acts as the founders clearly intended from the point of ratification forward.
2. It would either correct or remove unconstitutional Acts, which could easily be rationalized as "improper" or "misinterpretation" by earlier legislators and leaving the current legislators free from political suicide.

3. The members of the committee, being from multiple parties and now obliged under the threat of treason to follow their oath, would necessarily be more likely to follow a strict interpretation of the Constitution.

In addition to the above, the Original 13th Article of Amendment, Titles of Nobility and Honours, Ratified Mar 12, 1819, and appearing
in the official law codes until 1876, being "disappeared" during "Reconstruction" after the War Between the States be re-instated and be adhered to, this article in itself placing a barrier in the path of corrupt politicians.

Article 13 - "If any citizen of the United States shall accept, claim, receive, or retain any title of nobility or honor, or shall without the consent of Congress, accept and retain any present, pension, office, or emolument of any kind whatever, from any emperor, king, prince, or foreign power, such person shall cease to be a citizen of the United States, and shall be incapable of holding any office of trust or profit under them, or either of them."

The historical records shows that the Republicans of the early 20th century, acting as agents for those who had monopolized the
American economy, set the “wages-are-income” concept into motion by language placed into the federal tax code after the 16th
Amendment was passed.

The first stature threw all sorts of “sources of income” into the mix including wages. Other statutes then “benevolently exempted the
first $4,000 of a person’s “income.” Since the average American family’s earned income was about $500 a year at the time, it wasn’t
until after World War II, when this nation’s economy was really booming and national pride was peaking, that Americans really began
paying taxes on their wages.

In post-World War II America, Americans took for granted that they could trust the federal government and the average person had long since forgotten the debates of the income tax issue, as well as what the law considered “income” to be.

We have been conditioned since kindergarten to believe that wages and salaries generated from our labors are “income” for federal tax purposes, yet this book provides testimony in direct opposition to such conditioning.
The federal government knew what it was doing then, and it knows what it is doing today. The Constitution recognizes two kinds of
taxes: direct and indirect.

Congress does not have the constitutional authority to lay direct taxes against the people unless the tax burden is equally apportioned by population among the Several States. Congress does have the authority to lay indirect taxes on privileges, events and activities. Excise taxes on cigarettes, alcohol and gasoline are examples of constitutional indirect taxes. An excise tax on a corporate dividend is a tax on a privilege, as a corporation is a privileged entity created by government.

There is no intelligent way to argue that a tax on a man’s labor is anything but a direct tax. We work, get paid for our work and then get taxed according to the amount of money we are paid. If you don’t work, you don’t eat and you die. Whereas you can choose not to consume cigarettes, alcohol, gasoline or other products subject to excise taxes.

A tax on wages is a tax on our right to exist, in many ways similar to the feudal systems of old. Through threats, coercion, and “brown
shirt” tactics, the federal government deceives the American public regarding the constitutional limitations of their taxing authority,
leading to trillions of dollars being confiscated from the American People through questionable means. In effect, we are being taxed
without our consent because, as Hart points out in this book, consent was given according to the intent of the laws passed, not to the
deceitful levels commandeered by the contemporary federal tax enforcement apparatus.

For more than 60 years, the National Aeronautics and Space Administration (NASA) has known
that the changes occurring to planetary weather patterns are completely natural and normal. But
the space agency, for whatever reason, has chosen to let the man-made global warming hoax
persist and spread, to the detriment of human freedom.

It was the year 1958, to be precise, when NASA first observed that changes in the solar orbit of the
earth, along with alterations to the earth's axial tilt, are both responsible for what climate scientists
today have dubbed as "warming" (or "cooling," depending on their agenda). In no way, shape, or
form are humans warming or cooling the planet by driving SUVs or eating beef, in other words.

But NASA has thus far failed to set the record straight, and has instead chosen to sit
silently back and watch as liberals freak out about the world supposedly ending in 12
years because of too much livestock, or too many plastic straws.

In the year 2000, NASA did publish information on its Earth Observatory website about the
Milankovitch Climate Theory, revealing that the planet is, in fact, changing due to
extraneous factors that have absolutely nothing to do with human activity. But, again, this
information has yet to go mainstream, some 19 years later, which is why deranged, climate-
obsessed leftists have now begun to claim that we really only have 18 months left before
the planet dies from an excess of carbon dioxide (CO2).

The truth, however, is much more along the lines of what Serbian astrophysicist Milutin
Milankovitch, after whom the Milankovitch Climate Theory is named, proposed about how
the seasonal and latitudinal variations of solar radiation that hit the earth in different ways,
and at different times, have the greatest impact on earth's changing climate patterns.

If we had to sum the whole thing up in one simple phrase, it would be this: The biggest
factor influencing weather and climate patterns on earth is the Sun, period. Depending on
the earth's position to the sun at any given time, climate conditions are going to vary dramatically,
and even create drastic abnormalities that defy everything that humans thought they knew about
how the earth worked.

But rather than embrace this truth, today's climate "scientists," joined by leftist politicians and a
complicit mainstream media, insist that not using reusable grocery bags at the supermarket and
not having an electric vehicle are destroying the planet so quickly that we absolutely must
implement global climate taxes as the solution.

"The climate change debate is not about science. It is an effort to impose political and economic
controls on the population by the elite," wrote one commenter at the Hal Turner Radio Show.
"And it's another way to divide the population against itself, with some who believe in man-made

global warming and some who don't, i.e., divide and conquer."

NASA admits that climate change occurs
because of changes in Earth’s solar orbit,

We are the target of terrorists because, in much of the world, our government stands for dictatorship, bondage, and human exploitation. We are the target of terrorists because we are hated. And we are hated because our government has done hateful things.

In how many countries have agents of our government deposed popularly elected leaders and replaced them with puppet military dictators who were willing to sell out their own people to American multinational corporations?

We did it in Iran when the US Marines and the CIA deposed Mossadegh because he wanted to nationalize the oil industry. We replaced him with the Shah and armed, trained, and paid his hated Savka National Guard, which enslaved and brutalized the people of Iran, all to protect the financial interests of our oil companies. Is it any wonder that there are people in Iran who hate us?

What about Japan? We did it in Chile. We did it in Vietnam. More recently, we tried to do it in Iraq.

And of course, how many times have we done it in Nicaragua and all the other banana republics of Latin America? Time after time we have ousted popular leaders who wanted the riches of the land to be shared by the people who worked it. We replaced them with murderous tyrants who would sell out their own people so the wealth of the land could be taken out by the likes of Domino Sugar, Folgers, and Chiquita Banana.

In country after country, our government has thwarted democracy, stifled freedom, and trampled human rights. That's why it is hated around the world. And that's why we're the target of terrorists.

People in Canada enjoy democracy, freedom, and human rights. So do the people of Norway and Sweden. Have you heard of Canadian embassies being bombed? Or Norwegian, or Swedish?

We are not hated because we practice democracy, value freedom, or uphold human rights. We are hated because our government denies these things to people in Third World countries whose resources are coveted by our multinational corporations. That hatred we have sown has come back to haunt us in the form of terrorism and in the future, nuclear terrorism.

Once the truth about why the threat exists is understood, the solution becomes obvious. We must change our ways. Getting rid of our nuclear weapons unilaterally, if necessary, will enhance our security. Drastically altering our foreign policy will ensure it.

Instead of sending our sons and daughters around the world to kill Arabs so we can have the oil under their sand, we should send them to rebuild their infrastructure, supply clean water, and feed starving children. Instead of continuing to kill hundreds of Iraqi children every day with our sanctions, we should help Iraqis rebuild their electric power plants, their water treatment facilities, their hospitals, and all the things we have destroyed and prevented them from rebuilding.

Instead of training terrorists and death squads, we should close the School of the Americas [Ft. Benning, GA.]. Instead of supporting insurrection, destabilization, assassination, and terror around the world, we should abolish the CIA and give money to relief agencies.

In short, we should do good instead of evil. Who would try to stop us? Who would hate us? Who would want to bomb us? That is the truth the American people need to hear. We need to "respond" NOT "react".

It is the very nature of power that it attracts the sort of people who should not have it. The United States, as the world's last superpower, is a prize that attracts men and women willing to do absolutely anything to win that power, and hence are also willing to do absolutely anything with that power once they have it. If one thinks about it long enough, one will realize that all tyrants, past and most especially present, MUST use deception on their population to initiate a war.

No citizen of a modern industrialized nation will send their children off to die in a war to grab another nation's resources and assets, yet resources and assets are what all wars are fought over. The nation that wishes to initiate a war of conquest must create the illusion of an attack or a threat to start a war and must always give their population of cowards an excuse never to question that carefully crafted illusion.

It is naive, not to mention racist to assume that tyrants appear only in other nations and that somehow America is immune simply because we're Americans. America has escaped the clutches of a dictatorship thus far only through the efforts of those citizens who, unlike the Germans of the 1930s, have the moral courage to stand up and point out where the government is lying to the people. And unless more Americans are willing to have that kind of individual courage, then future generations may well look back on the American people with the same harshness of judgment with which we look back on the 1930s Germans.

Old saying, Figures lie and liars figure. This guy is pulling rabbits out of his hat. Earth's atmosphere is well understood and measurements show 270ppm -+ 50ppm CO2 for >800,000 yrs to 1850. Now over 400 ppm CO2. Where does he get his data? 30% increase is not all from natural sources, except some of the natural sources that are contributing are possibly doing so due to feedback mechanisms. i.e. Need to consider small changes in energy absorbed by natural sources exacerbates outflows of CO2. Examples would be permafrost thawing and contributions by extractive industries. See video post 154

to a point of insanity.

The very foundation of family must be grounded in love/respect, honesty/trustworthy, and when
these virtues are not put in place and acted upon.... families may often become an abomination of desolation...
abomination being something that causes disgust/hatred...and desolation being a condition that is
uninhabitable/devasted.
And this is precisely that of which is being witnessed across the land. This being indisputable.
Each may come to their own conclusion, but it appears this to be such a devastation of suffering and fear,
that of all people, renowned 'Christian' leaders are reluctant and purposely avoid this undeniable
