Ok, but isn't the guilty party the one who should be held accountable for any injuries sustained by others? Is the victim partly to blame because they were in the wrong place at the wrong time, or some such?

As for auto accidents, there is a reason the Insurance Companies and Law Enforcement came up with "No Fault" accidents. This happens when both parties are equaly responsible, right? Fault can not be blamed on either, for both are equally guilty?

But then, neither would be a "victim" either.......... :)

It all is on a case by case situation.

If equally responsible then both are at fault. Both are the perpetrator.

Im reading a book called To Be Fair confessions of a District Court Judge

The justice system in nz may be different from other countries, but from a judges point of view she has to judge on the misdeameanlur and how it hurt the victim and also balance how the person that did it can make amends to that person. The way it works is called restorative justice...it is not always practiced though

Because revenge never works in the long run its like drinking rat poison and expecting the other person to die.
sometimes the victim is just in the wrong place at the wrong time, but the victims dont always need to go to court and relive their trauma. That is why lawyers speak on their behalf.

Restoritive justice would be much wiser to practice if possible. Inmates should hold jobs within the prison system and part of their income should go to the victim.

Of course, that only works if the inmate is compliant. A life sentence or death row inmate may not even care to comply and act up in order to be isolated.

look up 'The right track' as this program seems to work with very low reoffending rates.
when someone has caused a big drama and hurt a lot of people and is confronted with the consequences of what they have done they learn that they CAN change their behaviour. This relates to driving but could apply to other areas of life.
