They ought to appeal.
I can see it if the photographers were government salaried...but a small private outfit? Call A.C.L.J.

Does this mean a homosexual photographer would be forced to photograph a wedding for the West Boro Baptist church?

Okay, I'm going to make a couple clarifications:

1. This ruling has already been appealed...twice. First from the trial court level to the appeal level and from the appeal level to the State Supreme Court level.

Not one judge, but many New Mexico Judges including one loser of a trial court judge, possibly ten appellate court judges (it does not appear that New Mexico is divided into districts like most states(see for yourself https://coa.nmcourts.gov/index.php) five New Mexico Supreme Court Justices.

The logical consequence is this.

2. The only place to appeal to is the US Supreme Court, and thankfully he can because it is a Constitutional issue.

3. The question then is fairly straightforward: is it worth going to the Nine Justices over it? My answer is yes.

Is it likely our photographer will get the answer he wants? No. It will give him more prominence though and serve as a starting point for education and a bit of agitation.

Overall though, the situation is depressing. These judges (all law school grads) don't know a thing about basic jurisdiction. That or they know the jurisdictional issue of which I speak and they are ignoring it like the Judges out in CA.

Good news: The nine NM Supreme Court Justices can be voted out. My advice: do it.

Really? Where in the first amendment does it say that we are "compelled by law to compromise the very religious beliefs that inspire our lives"? I can't find that anywhere in the first amendment.

What the first amendment says exactly is:

"Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances."

The First Amendment of the United States Constitution protects the right to freedom of religion and freedom of expression from government interference. Justice Richard Bosson has just taken it upon himself to deny the Huguenins their freedom of expression via government interference.

This is the opposite of what the founders intended and amounts to a form of state sponsored tyranny against religious persons.
