If the DS was "firmly in control" they wouldn't be taking the 5th. They are taking the 5th because they have no idea how much evidence Durham has and don't want to be caught lying.

Also, if they are taking the 5th it indicates they might be willing to cut a deal. Scarface doesn't take the 5th, he goes down in a hail of bullets, however, his associates seek to cut a deal.
