Harvard Public Law Working Paper No. 08-03
U of Chicago, Public Law Working Paper No. 199
U of Chicago Law & Economics, Olin Working Paper No. 387

Abstract:

Many millions of people hold conspiracy theories; they believe that powerful people have worked together in order to withhold the truth about some important practice or some terrible event. A recent example is the belief, widespread in some parts of the world, that the attacks of 9/11 were carried out not by Al Qaeda, but by Israel or the United States. Those who subscribe to conspiracy theories may create serious risks, including risks of violence, and the existence of such theories raises significant challenges for policy and law. The first challenge is to understand the mechanisms by which conspiracy theories prosper; the second challenge is to understand how such theories might be undermined. Such theories typically spread as a result of identifiable cognitive blunders, operating in conjunction with informational and reputational influences. A distinctive feature of conspiracy theories is their self-sealing quality. Conspiracy theorists are not likely to be persuaded by an attempt to dispel their theories; they may even characterize that very attempt as further proof of the conspiracy. Because those who hold conspiracy theories typically suffer from a crippled epistemology, in accordance with which it is rational to hold such theories, the best response consists in cognitive infiltration of extremist groups. Various policy dilemmas, such as the question whether it is better for government to rebut conspiracy theories or to ignore them, are explored in this light.

:)

the existence of a theory "raises significant challenges for policy and law"

okay....

The first challenge is to understand the mechanisms by which conspiracy theories prosper;
the second challenge is to understand how such theories might be undermined.

making a plan to undermine theories?

why on earth is that necessary?:) that sounds like a conspiracy.

"Because those who hold conspiracy theories typically suffer from a crippled epistemology;)
in accordance with which it is rational to hold such theories,
the best response consists in cognitive infiltration of extremist groups.

oh....this....is....rich.:)
conspire to undermine conspiracy theories through cognitive infiltration of conspir.....HEY...HOLD ON....WHAT? now he said EXTREMIST groups!

wow.

so, Mr. Sunstein, who apparently does not suffer from a crippled epistemology, needs to know how he can know what conspiracy theorists think they know but don't know since the attacks of 9/11 were carried out by Al Qaeda, not by Israel or the United States.

he has a dilemma because, as he points out:

"Conspiracy theories are by no means a strictly domestic phenomenon; they can
easily be found all over the world. Among sober-minded Canadians, a September 2006
poll found that 22 percent believe that “the attacks on the United States on September 11,
2001 had nothing to do with Osama Bin Laden and were actually a plot by influential
Americans.”5 In a poll conducted in seven Muslim countries, 78 percent of respondents
said that they do not believe the 9/11 attacks were carried out by Arabs.6 The most
popular account, in these countries, is that 9/11 was the work of the U.S. or Israeli
governments.7

Political abuse of psychiatry in the Soviet Union

In the twentieth century, systematic political abuse of psychiatry took place in the Soviet Union.[1] During the leadership of General Secretary Leonid Brezhnev, psychiatry was used as a tool to eliminate political opponents ("dissidents") who openly expressed beliefs that contradicted official dogma.[2]

The term "philosophical intoxication" was widely used to diagnose mental disorders in cases where people disagreed with leaders and criticized them using the writings of Karl Marx, Friedrich Engels, and Vladimir Lenin.[3] The process of psychiatric incarceration was instigated by attempts to emigrate; distribution or possession of prohibited documents or books; participation in civil rights actions and demonstrations, and involvement in forbidden religious activity.[4] Religious faith was determined to be a form of mental illness that needed to be cured.[5] Formerly highly classified government documents published after the dissolution of the Soviet Union demonstrate that the authorities used psychiatry as a tool to suppress dissent.[6]

According to the Commentary on the Russian Federation Law on Psychiatric Care, persons who were subjected to repressions in the form of commitment for compulsory treatment to psychiatric medical institutions and were rehabilitated in accordance with the established procedure receive indemnity payment. The Russian Federation acknowledged that psychiatry was used for political purposes and took responsibility for the victims of "political psychiatry."[7]

Following the fall of the Soviet Union, it was often reported that some opposition activists and journalists were detained in Russian psychiatric institutions to intimidate and isolate them from society.[8] In modern Russia, human rights activists also face the threat of psychiatric diagnosis as a means of political repression.[9]

CASS SUNSTEIN’S NEW PRESIDENTIAL APPOINTMENT IS ALMOST HARD TO BELIEVE…ESPECIALLY CONSIDERING A PAPER HE ONCE WROTE

Aug. 26, 2013 8:40am Fred Lucas

President Barack Obama named his controversial former regulatory czar – who as an academic advocated government infiltration of conspiracy theorists – to serve on the NSA oversight panel.

Cass Sunstein appointed to NSA oversight panel.

Cass Sunstein, who served as the administrator of the Office of Information and Regulatory Affairs throughout most of the Obama’s first term, advocated numerous policies as an academic – including the government infiltrating conspiracy theorist groups by joining “chat rooms, online social networks and real space groups,” in a 2008 paper he co-wrote at Harvard, as recently reported by The Washington Post.

“Those who subscribe to conspiracy theories may create serious risks, including risks of violence, and the existence of such theories raises significant challenges for policy and law,” the 2008 paper said.

“The first challenge is to understand the mechanisms by which conspiracy theories prosper; the second challenge is to understand how such theories might be undermined.” It continues, “Because those who hold conspiracy theories typically suffer from a crippled epistemology, in accordance with which it is rational to hold such theories, the best response consists in cognitive infiltration of extremist groups. Various policy dilemmas, such as the question whether it is better for government to rebut conspiracy theories or to ignore them, are explored in this light.”

The website ZeroHedge.com went so far as to ask if Sunstein is “America’s Goebbels?”

The National Security Agency oversight panel is mostly made up of national security experts such as former Central Intelligence Agency Acting Director Michael Morell and former White House anti-terrorism official Richard Clarke.

In another controversial stance, Sunstein advocated in a 2003 paper titled “Lives, Life-Years, and Willingness to Pay” for the University of Chicago that the government assign a higher monetary value to the lives of young people than to senior citizens with regards to health care spending. That’s a position he backed away from during testimony to the House Energy and Commerce Committee in June 2011.

oh, no crippled epistemologies going on here, man:rolleyes:

Mr. Sunstein seems confused though: maybe he's the good NSA oversight cop-guy

"Whether one supports or opposes the NSA spying programs, Snowden has done a public service by exposing them and igniting a debate about government surveillance that even the president says he welcomes. There is no reason for the mere existence of either program to have been classified by the Most Transparent Administration in History. The claims that terrorists have been tipped off by these revelations are not credible. Nobody seriously believes that until now terrorists didn’t know the American government is monitoring their email and phone calls. Sen. Jon Tester (D-MT) told MSNBC Wednesday, “I don't see how [Snowden’s leaks] compromises the security of this country whatsoever.”

In his 2003 book, Why Societies Need Dissent, liberal law professor Cass Sunstein pointed out that, in society, “a single dissenter or voice of sanity is likely to have a huge impact.” But the problem for dissenters is that they “have little incentive to speak out, because they would gain nothing from dissenting” and in fact might be punished."

Review Board Looks Like A Rubber Stamp Not An Independent Review Of NSA Spying

Redaction Equals Transparency

The recently released secret FISA court opinion is supposed to promote the idea that the administration elected on a promise of “transparency” is now making good on that pledge. There’s just one problem: a good 20 percent of the 83-page document is redacted, including some key paragraphs. It is to a large extent unreadable. But what else are we to expect from this Bizarro World administration – the most secretive in our history – where black is the new “transparency”?

Yet that’s just the beginning of the White House’s weirdly inverted response to the public outcry against its massive domestic surveillance program. At his press conference promising to “reform” the spying machinery, President Obama announced a “review board” to be appointed that would supposedly reassure his critics there really is no domestic spying program: the goal, as he put it, would be to strike a “balance” between civil liberties and the safety of all Americans.

A week or so later he made some appointments to this panel: former Counter-Terrorism Czar Richard Clarke, former special assistant for economic policy Peter Swire, former CIA Deputy Director Mike Morrell – and Cass Sunstein, a very close friend and confidant of the President. Sunstein formerly headed up the Office of Information and Regulatory Affairs: now a Harvard law professor, he has made something of a name for himself as an outspoken advocate of government spying. Being one of those really highbrow types, he calls it “cognitive infiltration.” Sunstein wants paid government agents to penetrate ostensibly subversive “conspiracy minded” social networks: in other words, he wants to set up a police state system of government spies and provocateurs.

“They have acknowledged my innocence. This means the world to me.”

With those words, Maher Arar finally loosened the long yoke that has followed him around since he was deported from the U.S. and sent to be tortured in Syria in 2002. It happened after the R.C.M.P. provided false information about his ties to terrorists.

He accepted a long awaited – and much cheaper – settlement package from the federal government Friday. He had originally been asking for $400 million. He settled for $10.5 million, along with another $1 million to cover his legal costs.

And he also received another benefit that may be beyond price – an official apology from Stephen Harper.

No money and accountability though from the US leaders that actually did the criminal act.

Arar also filed suit against the U.S. government for the crimes committed against him by its agents. But the U.S. government has repeatedly claimed that the people it sends to their fates at the hands of third-world secret policemen have no rights under U.S. law, and that the courts have no jurisdiction. By a 7-4 margin, the Second Circuit Court of Appeals agreed. For the majority, Chief Judge Dennis Jacobs wrote (PDF):

A suit seeking a damages remedy against senior officials who implement an extraordinary rendition policy would enmesh the courts ineluctably in an assessment of the validity and rationale of that policy and its implementation in this particular case, matters that directly affect significant diplomatic and national security concerns.

Maher Arar can't sue U.S. for sending him to Syria to be tortured, says court - National Civil Liberties | Examiner.com

So having the same name as a suspected terrorist is a security concern.

In the words of former CIA agent Robert Baer:

"If you want a serious interrogation, you send a prisoner to Jordan. If you want them to be tortured, you send them to Syria. If you want someone to disappear -- never to see them again -- you send them to Egypt."

With Syria and Egpyt unstable now, the US must be hoping Jordan remains relatively stable otherwise where are they going to send people who have the same as name as terrorists for "serious interrogation" ?

When are these dirt bags going to be indicted for war crimes. Maybe send Bush and his regime to Jordan ?

WHITE HOUSE The White House Intelligence Review Will Come by Year's End

Expect Obama administration officials to punt on new NSA disclosures until that time.

The United States is reviewing the way it gathers intelligence. This has now become a tired and oft-repeated phrase coming from the Obama administration, as disclosures continue to reveal the far-reaching extent to which the U.S. spies on its allies.

The latest, groundbreaking leak: the U.S. has been monitoring German Chancellor Angela Merkel's cell phone for more than 10 years.

While U.S. officials have been summoned to explain themselves to different European leaders—Spain being the latest—aides to President Obama, from press secretary Jay Carney to Secretary of State John Kerry, have said there is currently a review underway to determine where the American spying program should go in the coming years.

But finally, there's a sense of when exactly the Obama administration will release details of this review: by the end of the year, according to Carney.

Speaking on Monday, Carney was vague about the current review and said he would not specifically address the latest disclosures from Edward Snowden. Still, Carney said there's already been progress as the U.S. contemplates spying agreements with some of its allies, including Germany.

"Even as that work is being done, some decisions have been made that reflect the president felt desire to find the proper balance," Carney said at his daily press briefing.

There are currently two reviews ongoing. One is within the White House, run out of the National Security Council, which is what Carney is referencing. The other is an outside group, consisting of members that were appointed by President Obama—including the former acting director of the CIA, Mike Morell, and Cass Sunstein, the husband of U.N. Ambassador Samantha Power and former head of the White House Office of Information and Regulatory Affairs.
