innocense vs. stupidity

Okay, so my brother-in-law and i just had a big debate about this, and he was getting really annoying about it.

The question was:
If my dad threw a cup out of the window while driving his car, and it hit another vehicle and caused an accident, would i (being very close to my father,) want him to go to jail for it.

The response was:
I wouldn't want him to go to jail for it, but i think he should go to jail for it because he was being stupid about it.

When i said that, my brother-in-law looked at me like i was the most heartless person he's ever met...
so, is my morality skewed, or no?
 
If my father broke the law, I would expect he pay the price, just like everyone else.
