Authorities say 29-year-old Bailey Mercer targeted exhausted tourists visiting national parks by offering jars for $22 each at a wooden roadside booth decorated with pinecones and antlers.
According to investigators, Mercer claimed each jar contained:
“premium alpine oxygen collected above 7,000 feet.”
Customers were reportedly instructed to:
“open only during emotional emergencies.”
One family from Texas told deputies they bought six jars because they believed the air could:
“help them relax back home.”
Police say Mercer became defensive after a park ranger questioned how she was “capturing” the air.
Witnesses claim she demonstrated by dramatically waving empty mason jars through the sky before sealing them shut and whispering:
“That one’s extra crisp.”
Authorities also allege Mercer charged an additional $9 for “limited edition snowstorm air.”
The operation was eventually shut down after officials determined she lacked the permits required for commercial sales near the tourist area.
Mercer reportedly told officers:
“If candle companies can sell beach smells, I can sell Montana.”

The picture says cited. Was she prosecuted or just told to stop selling it near a tourist area? Also she should get a specific proximity on "near."
I'd get some distance specifications and reopen. No crime has been committed. Add an ebay listing and put it on Facebook marketplace. If people are silly enough to buy it, let her sell it.

Agree, good idea, I can only assume that if she was 'cited' and shutdown that she will have to either pay a fine or go to the local court to contest her citation...
