The officer could easily have just written her citation and sent her on her way. He chose to escalate the situation.

No she chose to shoot her mouth off and not comply with what the officer told her to do! What is it with people these days? Are people that stupid? Put out the blinkin cig and say yes sir,no sir and you're done. Then go and complain if you think you were done wrong. She shot her mouth off.Then when told to get out of the car,she refused. She cursed like a sailor and resisted the officer the whole time. Then you hear her crying and all upset that it got to that point.She did it to herself.Do what the cop tells you to do! Its the law.Complain after if you think the cop was in the wrong.Her whole day could have gone differently if she had complied. If the officer overstepped his bounds,punish him.But she was the one that took it to a hysterical level. Her own fault.

That arrest was more like an abduction. The only reason she changed lanes in the first place is because he was tailgating her. He was already looking for trouble when he asked her to put out her cigarette.

He's a cop.He has a right to tell her to put out her cig.Had she complied ,she could have gone on with her day.

Why on Earth wouldn't the news team post the number? How we supposed to keep up with the hate if we can't even get a phone number? :mad:

He's a cop.He has a right to tell her to put out her cig.Had she complied ,she could have gone on with her day.
she should have been allowed to smoke in her own car.....it was all about control

The cop asked her if she WOULD put out her cig.. She said no, I don't have to, which is true. It was a request, not a direct order from the cop to her. She had every right to refuse to put it out, seeing as how she was IN the car, so the smoke wouldn't have affected the cop at all. What this woman went through was horrible, especially getting her head slammed on the concrete 3 or 4 times.. :/ JMO

notice how he conveniently moved her out of view in the camera before assaulting her?...the whole thing started over the cigarette because she did not get belligerent until she was asked to exit her vehicle. ..the only reason the officer asked her to ask the vehicle was because she refused to put out a cigarette....he was just angry because she refused to cower beneath his authority

Yeah the cops can't stand it when some of the people they pull over, know their rights better than the cop does. They don't like being made to look like an ignorant jerk on camera.. :/

also look at the video and the office for the description of the events...there are numerous discrepancies in his story. then he had to make up a reason for the original arrest. how do you get arrested for resisting arrest?

I agree with you wholeheartedly that she just should have complied. It wasnt law for her to comply but it is common sense to avoid trouble at all costs.
Common sense is not at all common.

Listen these news stories get tried in the court of public opinion,it means nothing.We have a court and a justice system for a reason. She may have had a right to smoke but why bother arguing with the cop? Lay a complaint later. He told her to get out of the car,then get out. Follow what he says and lay the complaint after. Now we have a whole lot of who shot John that wasn't necessary. Its up to the courts to find out where the cop went wrong and punish him if he did. Whether he was right or she was right,she was the one that escalated it.

For instance,I was walking my little dog at our local
[FONT=arial, sans-serif]capitol building.Its a beautiful place to walk with lots of steps for exercise. I was with my husband and my mother.As we were walking along a guy in uniform comes up to me and said something about a nice day.Then he said "you cant have that dog here". Well I'd seen lots of people with dogs. I said "well, there is no sign". He said "I told you dogs arent allowed " and pointed me to the grass.Now my husband thought the guy was a cop. So he said that I shouldnt have questioned him. Well I knew the guy was in the wrong. So I did what he said but went home and called the capitol building. They were told what the guy said in uniform.I said there were no signs posted saying no dogs and there were no signs posted to pick up after your dog.They agreed that there were no signs and that he was out of line in stopping us.Now,he was only a security guard,I didn't know that.But I didnt curse and carry on and kick dust at him. They asked for his description and said they would be talking to him. I havent been stopped since. So why get yourself arrested when you can go and complain after the fact? [/FONT]

If that is the case she should have been wise enough to just avoid trouble and just put the cig out! Whats the big deal?
This woman may have been a target and the cop did act unlawfully but that doesnt excuse her acting like a crazed stupid woman. Ignorance is bliss.

I believe she was deliberately targeted because she was a known civil rights activist. Maybe she didn't want to get outbif the car because she knew she would be man handled.... Which she was....

No.the best thing to do is to comply even if you feel your rights are being violated and then file a complaint or a lawsuit if you it is warranted. Sandra bland probably should have complied as well but these officers actions were unprofessional.instead of attempting to deescalate the situation, he did the exact opposite. in fact she only got belligerent when he demanded that she step out of the car..I see no reason to ask her to exit the vehicle for a simple traffic stop....when you refuse to comply, you are playing right into their hands because often they are hoping you don't comply. some of these police officers are violent sociopaths who are looking for an excuse to hurt you. don't give them that excuse
I have been asked to step out of the vehicle when stopped for a headlight out. We walked behind the vehicle, he wrote me a repair citation, and we both returned to our vehicles. I had no problem with it. Looking back, after seeing an officer hit by a passing motorist, I see that it was his personal safety that he was concerned about.

Again, respect is a two way street. If an officer ask you to step out of your vehicle, and even go back and sit in his vehicle, comply. At the worst, you will leave with a citation. Most likely, unless you have outstanding warrants or holds, you are going to get a warning, or a short lecture on safe driving.

I agree that if you have a complaint, file a grievance.

there is no question that our justice system is racially biased. Jared Fogle only got 15 years for his crimes against children,wale black lady in Florida got a 20 year sentence for firing a warning shot at her husband who had multiple counts of domestic violence and had made death threats.She was released this month after it was made public that the jury had been given improper instructions.
