From a tactical standpoint, it's a private school. I'm sure there's an agreement signed by the parents saying that all enrollment/expulsion decisions are ultimately up to the school's administrators. Also, she was 16 when this happened. A 16 year old can't get a "donation" or surrogacy if I'm not mistaken.
Bible wise, suing is not meant for us. We aren't meant to engage in that kind of behavior, even in severe cases.
1 Corinthians 6:7
"[SUP]7 [/SUP]Now therefore there is utterly a fault among you, because ye go to law one with another. Why do ye not rather take wrong? why do ye not rather suffer yourselves to be defrauded?"

Lawsuits should never be the first choice of believers, or any people for that matter, but it is how we can prevent people from doing the same bad thing to others. Also, the context of Corinthians is that they were robbing each other in court, not just pressing charges (there is a difference). In the modern legal system, it's the difference between frivolous lawsuits (bad) and seeking justice (good).
