There seems to be two unique things: the promise of the Holy Spirit and the baptism with the Holy Spirit.
In John:
"And when He had said this, He breathed on them, and said to them, “Receive the Holy Spirit. 23 If you forgive the sins of any, they are forgiven them; if you retain the sins of any, they are retained.”
Later in Acts 1:
"And being assembled together with them, He commanded them not to depart from Jerusalem, but to wait for the Promise of the Father, “which,” He said, “you have heard from Me; 5 for John truly baptized with water, but you shall be baptized with the Holy Spirit not many days from now.”
So, the original receiving of the Spirit in John was not the baptism of the Spirit Jesus spoke of in Acts 1, else there would have been no need to complete it again.
And then in Acts 2 we read this:
"Then there appeared to them divided tongues, as of fire, and one sat upon each of them. 4 And they were all filled with the Holy Spirit and began to speak with other tongues, as the Spirit gave them utterance."
The first "receiving the Spirit" in John coincides with the baptism into one body as written in 1 Corinthians:
"For in one Spirit we were all baptized into one body. Whether Jews or Greeks or slaves or free we were all made to drink of the one Spirit"
Entrance into the Body of Christ requires the rejuvenation of the spirit, spiritual birth. Since the Body of Christ is spiritual, this transaction is spiritual. The flesh cannot inherit spiritual things. Also, this is not water baptism: we do not drink the Spirit during water baptism. Immersion in water is burial into the likeness of Christ's death.
Furthermore, Paul directs the Ephesian saints to "be filled with the Spirit":
"Therefore do not be unwise, but understand what the will of the Lord is. 18 And do not be drunk with wine, in which is dissipation; but be filled with the Spirit..."
So, it appears to be an ongoing thing to be filled with the Spirit, not as a right to be included into the Body of Christ, but as a normal function of the life of a saint.
Even the disciples, after being filled in Acts 2, are filled again in Acts 4:
"And when they had prayed, the place where they were assembled together was shaken; and they were all filled with the Holy Spirit, and they spoke the word of God with boldness."
The question is "Is laying of hands necessary in order to receive the Holy Spirit?" I haven't even broached that topic. The answer is "Maybe". If you have not received the Holy Spirit that is evidenced by power, then God can give it to you directly or He may send someone to you to lay hands on you so that you may receive it. If you are a believer, and have accepted Christ as your Lord and Savior, then the Spirit of God is within you. It's by that Spirit you cry out to your Father in Heaven. But, if you do not have power in the Spirit then you may asked to be filled by the Spirit. That is a separate thing and an on going request as you have need.

No one received the holy spirit here though which is the basis for your whole argument that they received the spirit here and then again a second time
“Then said Jesus to them again, Peace be unto you: as my Father hath sent me, even so send I you. And when he had spoken these things, while they beheld, he was taken up; and a cloud received him out of their sight.”
Acts 1:3-9
See they hadn’t received the holy spirit when Jesus breathed in them he just said receive the spirit later they did at pentocost as he said there in a few days they would receive the promise
they couldn’t have received the Holy Ghost until Jesus ascended to the throne and delivered the promise at pentocost is the thing
this had to happen like Jesus had explained before they could receive the spirit

Peter said this moments after receiving the Holy Ghost
“And there appeared unto them cloven tongues like as of fire, and it sat upon each of them. And
they were all filled with the Holy Ghost, and began to speak with other tongues, as the Spirit gave them utterance.”

Your argument is based on what it doesn’t say there there Jesus was speaking forward to when they would receive it they hadn’t received the spirit yet remember it’s all based on the promise
Jesus had to be exalted first
“Nevertheless I tell you the truth;

I go not away, the Comforter will not come unto you; but if I depart, I will send him unto you.

“If ye love me, keep my commandments. And I will pray the Father, and he shall give you another Comforter, that he may abide with you for ever; even the Spirit of truth; whom the world cannot receive, because it seeth him not, neither knoweth him: but ye know him; for he dwelleth with you, and shall be in you. I will not leave you comfortless: I will come to you. Jesus answered and said unto him, If a man love me, he will keep my words: and my Father will love him, and we will come unto him, and make our abode with him. He that loveth me not keepeth not my sayings: and the word which ye hear is not mine, but the Father's which sent me. These things have I spoken unto you, being yet present with you. But
the Comforter, which is the Holy Ghost, whom the Father will send in my name, he shall teach you all things, and bring all things to your remembrance, whatsoever I have said unto you.”

remember he commanded them not to leave Jerusalem until they received the holy ghost and were empowered to preach the gospel that’s why you see them start preaching just after they receive the Holy Ghost at pentocost if you receive the spirit you have gods spirit inside your heart it’s a basic promise of Jesus to believers

Being filled with the spirit , receving the gift of the spirit , receiving the spirit it’s all one thing we have different gifts when we receive the spirit but there’s just receiving gods spirit or nOt receiving it they only received the spirit when it says they did
