Well, yeah, but she did agree to not interfere with her deputies when they issue marriage licenses, too. That's a pretty big aspect of the whole case.
Her lawyer is speaking now, he says they are still in talks about what her next step is.

Watching Fox while wolfing down a sandwich between clients, but it was made clear she has agreed not to interfere with her deputies in issuing marriage licenses.

I'll keep watching,I missed that while vacuuming the house. lol Either way the fight is on.I havent seen my local news as to how many people are protesting there.My sister is on her way there now. There is a rally where Kim Davis is to speak. I doubt she'll be allowed to say much.

Judge orders Ky. clerk who denied gay marriage licenses released from jail

Bunning lifted that order Tuesday, allowing her to be released. He said the court is "satisfied" that since last week, the clerk's office has been issuing marriage licenses "to all legally eligible couples" -- those licenses have been issued by Davis' deputy clerks.

At the same time, Bunning directed Davis not to "interfere in any way" with the marriage licenses now being issued by her office.
The unspoken but very clear implication is that, if Bunning thought there was a chance she would not comply with that directive, he would not have signed the order. Therefore, she or her attorney has given some kind of agreement, clearly or tacitly, to non-interference or she would still be sitting in the Rowan Country Jail.

If she goes into the office this week or next, whenever she returns to work, and interferes with the issuance of marriage licenses, she will be right back in lock-up. Somehow, regardless of what statements her attorney has made, she has to have given the judge at least the grudging impression she won't interfere.

No I just heard the mans words...live Not some reporters understanding. Even FOX is saying now that it don't appear this is the deal she made and her lawyer for sure didn't seem to be yielding on that point.

And that Judge can see that locking this woman up ..it not advancing the gay agenda ...I hope she resist further and half a million people show up next time...had I know I only had half a day of work I might have taken a nice ride up there myself to day :)

I'm listening to Fox also, as I said. All they've said is that there is no indication from Davis or her attorney what they will do, but I guarantee you -- as I appear before judges all the time regarding parolees and probationers -- if they detect the slightest indication you're not going to comply with the very letter of their directives, they don't cut you any slack.

You guys can believe what you want, but she'd still be in lockdown if Bunning thought she was going to interfere with licensure. The case isn't over. That doesn't mean she's going to continue refusing to issue licenses, or interfere with her deputies in doing so. It just means "the case isn't over."

Well they wont have her name on it..and they may not be legal in Ky...without her name ...so that federal judge is going to be walking all over state laws to pull this off... He may not be able to do what he thinks he can do and she may not have agreed to what these reporters are suggesting she did?

Her lawyer said those documents signed without her name WAS NOT VALID...don't sound like he believes some agreement was made.....

He's not a judge, he's her lawyer, and that's simply his legal opinion as regards his client, because ... well, she's his client.

But it is perhaps indicative of Davis' next move. She will testify for anyone who wants to allege in a civil suit that the license they receive isn't valid without her signature, and her attorney will probably file the suit for the complainant.

It will still be up to another judge to decide whether that's a valid argument.

She got out of jail because the judge wanted to save face in front of all the news cameras and protesters.

It usually takes the media two days to get any story straight :rolleyes:
