FACT: Jesus had not died nor had he been resurrected when he and the thief was on the cross, so the OT Laws was still in effect...
FACT: The New Testament Contract started AFTER Christ died and was resurrected...since Baptism is to Join in his death and resurrection then the thief nor any one else could have been baptized into HIS Name Before that happened....

And even if the thief was bound under the OT covenant, Jesus is the master of the Covenant. Should He choose to make an exception for the thief, He has the authority to do so.
